It is the job of an attorney to obtain appropriate compensation for clients who have been seriously injured or killed as a result of negligence. Maximizing your result is possible through:

ATTORNEY FEE
Our firm and many others work on a contingency-fee basis. This means the attorneys' fees are paid as a percentage of the compensation recovered. Hence, if there is no recovery, there is no fee. The amount of the contingency is agreed upon when the attorney is hired, before beginning any work. The specific fee provision will be contained in a written fee agreement. The client understands exactly what the percentage is, and there are no hidden charges.

COSTS
Litigation is expensive. The costs and expenses incurred in litigating a major case can be enormous. Nevertheless, your attorney may pay all of these expenses or obtain financing of expenses in advance of any recovery. Most firms receive reimbursement for their costs only when and if a recovery is obtained on your behalf. Responsibility for reimbursement of litigation costs will be addressed in the written fee agreement.

One of the first steps in a wrongful death action is therefore to hire a separate probate attorney who will handle such matters as life/accidental death insurance policies, administration of the estate, and resulting tax matters. A personal representative, usually from the family, will be designated to assist in this process.

Hiring a separate probate attorney can be helpful in two ways:

First and foremost, a probate attorney will ease the burden on the victim's family members, allowing them to focus on family issues and their own emotional well-being, instead of paperwork and deadlines.

Second, by attending to these matters, the probate attorney allows the personal injury attorney to begin investigation of the merits of the civil litigation.

Essentially, the probate attorney handles the immediate legal matters arising from the victim's passing, while the civil litigation attorney seeks compensation from the persons at fault.
